Darlo Drama terms and conditions

Please read this information carefully. By enrolling in and attending a course, you agree to be bound by these Terms and Conditions.

PRICING
  • All prices on the Darlo Drama website are shown in Australian dollars (AUD). Prices include GST unless indicated otherwise. 
  • Fees for courses are for tuition only and do not, unless expressly stated, include the cost of consumables, personal learning tools, or other incidental costs. 
  • Some third-party transaction costs may be passed on to the purchaser.

ALL FEES ARE NON-REFUNDABLE
  • All course fees including deposits are non-refundable. Please choose carefully, as we are legally not required to give refunds if a customer changes their mind. 
  • In the event a course is cancelled by Darlo Drama, a full refund, credit, or transfer to another course will be offered.
  • Refunds, credits or transfers will not be give if you miss a class, or your personal circumstances change.

COURSE TRANSFERS
  • Course fees are not transferable to another person once course has commenced.
  • Students may transfer to another course or location without financial penalty if notice is given in writing within 7 days of the original course start date.On some occasions we will accept transfers to another course or location with less than 7 dyas notice, and prior to the date of commencement of the original course upon payment of a $100 transfer course transfer fee

PRICING FOR “PAY UPFRONT” PURCHASES 
  • The listed price of the course where the entire course fee is paid upfront prior to the course commencement may be DISCOUNTED from the total course cost listed when a payment plan is chosen. 

PRICING FOR “PAY IN SIX” PAYMENT PLANS
  • The listed price of the course where PAY IN SIX is chosen, may be higher than the price where the entire course fee is paid upfront prior to the course commencement. Where a customer chooses to enter into a PAY IN SIX payment plan, their choice means more administrative tasks, time, cost, and increased risk for Darlo Drama. The fee is designed to cover some of these costs.

“PAY IN SIX” PAYMENT PLAN TERMS
  • By selecting to enter into a payment plan you acknowledge that you have entered into a legally binding agreement with Darlo Drama and you are committed to paying ALL INSTALMENTS of the full enrolment fee within the listed time frame. 
  • By selecting to enter into a payment plan you authorise Darlo Drama to make debits to your nominated credit card account.
  • At the time of enrolling in the course and selecting to enter into a payment plan, the first payment will debit to your credit card. Darlo Drama will then debit the remaining payments at the frequency listed until the total fees have been paid.
  • You authorise Darlo Drama to attempt to re-debit any unsuccessful payments. You will also be responsible for any fees, costs or charges incurred by Darlo Drama due to any unsuccessful payments.
  • You are responsible to ensure there are sufficient funds or credit available to meet all payment plan amounts consistent with the frequency listed in the payment plan
  • In the event a payment is unsuccessful you will receive notification requiring you to update your payment method and to arrange for payment of all remaining fees. A fee of $65 will be charged for any and all late payments.

RECOVERY ACTION OF UNPAID FEES
  • If your fee remains unpaid we will send you a debt recovery order which includes an overdue fee of $65 PER PAYMENT. If you don’t pay the amount owing, including the overdue fee we will start recovery action and apply additional costs.
  • Recovery action will include the issuance of a Letter of Demand in the first instance. If the debt remains unpaid Darlo Drama will take legal action to recover all unpaid fees.
  • All fees and costs incurred by Darlo Drama to recover unpaid fees will be passed on to the customer.

DARLO DRAMA LOCATIONS
  • Darlo Drama courses operate out of various locations across Australia. It is the responsibility of the student to ensure they are enrolled in the location of their choice.
  • Darlo Drama utilise a variety of community or shared venues across Australia and as such does not accept responsibility for the condition or facilities provided in these venues.
  • It is the student’s responsibility to check the location address of their course. 
  • Darlo Drama reserves the right to change a class location at any time before, or during any course. 

RISK AND INDEMNITY
  • Participating in a Darlo Drama course may involve physical activity and as such the student accepts responsibility to ensure they work within their personal limitations.
  • Darlo Drama staff and teachers cannot be held responsible for the actions of other students or visitors to Darlo Drama.
  • Upon enrolment into any Darlo Drama course, the student understands that all innate obvious risks associated with course, including, but not limited to, all risks of personal injury and any losses occurred by participating in the course are the responsibility of the student.

SAFETY, WELLBEING AND INCLUSION
  • Darlo Drama is committed to providing a safe and inclusive learning environment. We do not tolerate or condone any behaviours the constitute bullying, discrimination or harassment toward any staff member, teacher or student.
  • If a student, staff member or teacher is accused of bullying or harassment, Darlo Drama management will investigate the situation and consult with all parties. In the event the investigation is ongoing, it may be deemed appropriate to restrict access to a class or Darlo Drama venue as a precautionary measure.
  • Any student, staff member or teacher who is found to have committed discrimination, bullying, or harassment may be removed from the course permanently. In the event of this being a student, there is no entitlement to the refund of any fees.
  • Should a student be found to have committed any illegal act on a Darlo Drama venue, or an illegal act that involves or affects a Darlo Drama staff member, teacher or student that person will be removed from the course and from returning to Darlo Drama. There is no entitlement in to the refund of any fees in this situation.
  • Should Darlo Drama staff, teachers or students call an ambulance for any student, the cost of that ambulance will be incurred by the student.

PHOTOGRAPHY AND FILMING 
  • Darlo Drama may photograph or film the image of a student from time to time over their participation in course activities.
  • The student gives permission for any photographs or other media recordings taken during Darlo Drama courses to be shared on social media, in print or on the Darlo Drama website.
  • The student may request in writing, if they do not wish for their image to be taken or used by Darlo Drama.

RIGHT TO MAKE SUBSTITUTION OF TUTORS
  • All of Darlo Drama’s teachers are professional, working tutors and artists. We reserve the right to make substitutions in the event that they are unable to make the session due to other professional commitments.

CHOICE OF MONOLOGUES, SCENES OR PLAYS
  • Teachers will have the final decision on the casting of students in any monologue, scene or play. 
  • The choice of materials used in classes and performances is at the sole discretion of the teacher.

DISCOUNTS
  • From time to time, Darlo Drama may offer discounts, either in person, in publications, via email or online. The user will need to enter valid coupon codes during checkout to access the discount. 
  • Discounts cannot be applied retrospectively.

PRIVACY POLICY
  • This site uses TLS certificates to protect your privacy and security. It is regularly audited to ensure it complies with the credit card industry PCI standards.
  • The site may store cookies in your browser and your browsing details may be anonymously stored in order to assist with website analytics.
  • Darlo Drama adheres to the thirteen Australian Privacy Principles (APPs) issued by the Office of the Australian Information Commissioner (OAIC) oaic.gov.au/privacy.
  • Keeping information secure is a priority for the Darlo Drama. We respect the privacy of students, educators and staff.
  • Information provided by individuals to Darlo Drama is for the purposes of facilitating access to (including enrolment) and participation in Darlo Drama’s education and training courses.
  • Darlo Drama takes all steps to ensure that the personal details of its students and staff are not released to unauthorised persons or organisations, and personal information received by the Darlo Drama is kept secure in appropriate systems and record repositories.
  • If you have an urgent concern that the personal information collected by Darlo Drama is incorrect and/or is not properly secure please notify the Manager at admin@darlodrama.edu.au

PRIVACY AND MARKETING
  • Darlo Drama will, from time-to-time, send SMS or emails to students and past students for the purpose of marketing and course information.
  • Students may at any time request that all such marketing cease. Such requests should be given in writing. 
  • Darlo Drama may, from time-to-time, contact students by other means such as post and telephone for marketing activities. Students who request so will be removed from any marketing lists.
  • No personal information is ever or will ever be disclosed to unauthorised persons or organisations.

SECONDARY MARKETING
  • Darlo Drama does not allow for the use of student information for any secondary marketing not related to Darlo Drama, it’s events or activities.
